Open Thread for Ken

My apologies to all for having slacked off on posting.

In the meantime, will someone please address Mr. Bingham’s smug comment

“Is Ed Firmage saying “Death of the Constitution” or “Death to the Constitution”?

It’s Professor Firmage to you and the rest of us who hang on his every word as not only one of the greatest constitutional scholars of all time, but also the keeper of the truth and spirit of our Constitution.

I do believe Ken is responding from the perspective of one who subscribes to the “Hatch” version of Consitutional intepretation in which a majority belief should trump the safeguards inherent in the same as with the tired Senator’s justification for pushing the failed flag burning amendment.

As one who has shared the stage with Professor Firmage and other distinguished Utahns in a civil public debate last summer, you (Ken) are under an incumbency to qualify your remark such that we may understand it.

Your thoughtful elaboration will also help Ed better assist all of us in understanding the constitution and protect us all from the dangers of an increasingly shrill populous bent on subverting it for political purposes.

    I’m guessing that Ken simply felt the tiltle (I’m not sure that Ken took the time to read the entire lengthy contents of the article) was a little dark and bleek for his taste. I think I would have worried for the constitution if the Flag Burning Amendment would have passed

    Ken is simply doing his job as a good foot soldier of the 101st Fighting Keyboard Brigade and promoting King George’s Glorious Cultural Revolution and Quest for World Empire. What he meant to ask was “Why does Professor Firmage hate America so much?”

    Or perhaps he meant to say “You’re either with us (Constitutional revisionists) or you’re with the terrorists!”

    Well put, Cliff. Sadly, those like Ken tend not to have the technical understanding of the topic to claim any sound foundation for their opinions.

    Cliff is correct for taking me to task on this one. I should have been more respectfull. For now on I will address you as Professor, or Dr. Firmage. I offer my deepest apologies. Even though I fervently disagree with you politically I still have great respect for you personally and professionally.
