SB 210 - Voter Suppression in Utah

One of the favorite tactics of Republicans, especially in the era of Karl Rove, is voter suppression. This is the grab bag of legal requirements and sometimes dirty tricks aimed at discouraging poor people and minorities from voting.

When you hear claims of “voter fraud” coming from the GOP, watch out. They are pushing some new voter suppression scheme. The latest is SB 210 - Proof of Citizenship Required to Vote (PDF), sponsored by Senator Mark Madsen (R-UT 13) from Eagle Mountain. This bill would require Utahns who want to be registered voters to submit a copy of their driver license issued or renewed after July 1, 2005, birth certificate, passport, naturalization name and certificate number, or documentation of membership in a Native American tribe.

Obviously, this would have a chilling effect on volunteer voter registration drives, given the concern we all have about identity theft. It will force most people to register in person at the DMV or county clerk’s office, which means taking time off from work to stand in long lines. Maybe new voters will get discouraged and decide to avoid the hassle.

The ostensible reason for SB 210 makes no sense. There is no evidence of voting by non-citizens in Utah. For example, 600,000 Salt Lake County registration forms have been checked by the offices of Social Security, Homeland Security and Immigration and Customs Enforcement with no finding that anyone has illegally registered to vote.

Sufficient safeguards against illegal registration are already in place. Recently updated voter registration applications already require place and date of naturalization, date and place of birth, driver license or state identification card number, and last four Social Security digits. Applicants already must sign a citizenship affidavit and declaration that they are eligible–over 18, a citizen, not an incarcerated felon, living at the address given, and residing in Utah 30 days before the election. A penalty of up to one year in jail and a fine of up to $2,500 is noticed on the form. Voters who vote illegally can be prosecuted under current law.

The county clerks of Salt Lake, Weber and Davis are opposed to SB 210, along with the League of Women Voters. This bill is an attempt to interfere with the right to vote, by making it harder to register new voters.

UPDATE: Today the Senate decided to circle SB 210, which means they temporarily postponed action on the bill.

UPDATE: The Salt Lake Tribune notes that the American Civil Liberties Union also opposes this bill.

“As even the sponsor of this bill has indicated, SB210 is merely ‘precautionary,’ as there is no evidence to support the practice of voting by undocumented immigrants in Utah,” said Marina Lowe, staff attorney for the ACLU of Utah. “Unfortunately, the lesson learned by Arizona after enacting similar legislation is that large numbers of voter registration forms from U.S. citizens were rejected because they lacked the documents needed to prove their citizenship. The right to vote of Utahns is too fundamental to be sacrificed in the name of a hypothetical harm.”

    What kind of idiot are you, Richard? Too busy hugging illegal aliens that are mowing your lawn and cleaning your house to understand that SB 210 is a bill to ensure that CITIZENS vote and not illegals?

    Following the law, abiding by the law and supporting the law is “work” that illegal aliens just won’t do. Therefore SB 210 is needed to ensure they do follow the law and not vote!!!

    Hey, as long as the legislature is still in session, let’s pass a law that says interstellar spacecraft can’t land in Utah without a permit. The number of documented examples is equal to that of voting by non-citizens.

I mean we are all “citizens of world” aren’t we? We should allow anyone who wants to vote whether they are citizens or not.     I would expect nothing less from you. For one that always sides on the so-called logic points of an issue, you sure miss the point on this post. Studies from accross the country have concluded precisely the same results set forth by the top post: there is little to no voter registration fraud from illegals, and requiring proof of citizenship beyond that already required leads to the poor and others entitled to vote to simply not jump throught the hurdles and not vote.

    You should just stick with your apologist theories for the current administration and stay away from topics that are logically defensible, as you lose every time!!

    Here is an article about Senator Bob Bennett bringing up decades old stories about voter fraud. Republicans are always telling stories about dogs, dead people, cartoon characters, or bums who were given cigarettes to vote a certain way. It’s not happening and if it did it is so rare, it’s not even worth talking about, and yet you hear the words “voter fraud” repeated endlessly. A plethora of “election fraud” is happening in America, but you never hear about that.

    Speaking of cartoon characters. As Richard notes in a reply to my article, Ann Colter is responsible for the only known case of voter fraud lately and is definitely a felon. The attorney purge scandal that the media has barley covered, even though it has the potential to stop our democratic republic has connections to this whole voter fraud scam.

    You need a license to drive, you need legal registration and residency to vote. All manner of rights are contingent on proof of identity. You can’t return anything to a store without a receipt, and you must sign to do that. Be serious.

    So what if there are patches of election fraud committed by a handful of democrats 40 plus years ago. We are talking about today.

    The illegal aliens are NOT voting, they’re trying to stay invisible. The attorney purge scandal has proven the courts are being stacked against the democrats. A lot of honest attorneys have been replaced with dishonest ones, and the bad ones never had to leave. The Republicans have been putting this system in place for decades and would love nothing more then to see us little people fighting amongst each other.

    The question I cannot answer is why the Democrats aren’t doing more to alert the people, other then the fact that they would be called conspiracy theorists and not backed up at all by the media. It’s a huge problem. That’s why the forefathers were so keen on freedom of the press. I guess they knew people wouldn’t have the time or means to find out what was going on, and had to rely on commentary from others.

    I think what happened to Don Siegelman has happened to many others including Max Cleland, a true war hero who was supposed to have lost his election because they likened him to Sadam. All they have to do is say that’s why people decided not to vote for him at the last minute and then rig the election. That’s why Democrats can’t win enough seats to make a difference. They should be screaming and shouting anyway though and NOT voting for bad bills and appointments.

    Larry, in Washington State the governors race was decided by 110 votes. A man I know personally went to the counties of the State and got the public access records for people that wish to be recused from jury duty. Their excuse, they openly admitted they were unqualified as they were illegal aliens. The judges agreed and they returned back their homes in Washington State. The man then, after the election, picked up the names of all the registered voters lists from the counties, utilizing a computer program, he compared the lists names, addresses, and bingo, a portion the illegal alien names that declined jury duty showed up as registered voters. The record shows, that sure enough, they voted.

    The man I know that did this only became interested when voter registration paperwork came to his address for his parents. It had been going on 8 years. Only one problem. They had been dead for 10 years. His original intention was to see how many dead people were voting, he then expanded that to felons, and then illegal aliens. Some do vote Larry. 800 at least.

    Many illegals have stolen SS#’s, drive with no insurance, break a few laws here and there, voting would be no big deal Larry, just fill out the paperwork.

    Just consider, 30% of felons in our Federal prisons are illegal aliens. If we are concerned about vote fraud, and I have listened to the complaining of people on this blog, you being one of them… I ask again, given the evidence of fraud, are you not interested in controlling all avenues that could corrupt the system? We have a sitting governor up here that likely would not have won if the some 1000 votes of unqualified voters had not participated.

    It isn’t just republicans, this is has been going since day one. It is the weakness of democracy. Bad people, bad democracy.

    I don’t know what to tell you pop. I guess when Utah starts electing illegal aliens to high office and the temple is converted into a dance hall for Mexican fiesta’s and I’m forced to do slave labor because I’m white, I’ll have to admit I was an idiot, but I just don’t see it happening.

    Just after the HUGE rallies here in Salt Lake were held, because the immigrants stood up and said we’re not going to sit by and watch some of our people be made into felons and slaves because they got forced out of their own country by NAFTA, I went to a much smaller immigrant rally at the city and county building with a sign that said “Criminalize Sensenbrenner.” I had to explain to most of them that Sensenbrenner was the guy that was trying to get the legislation passed. The people were very nice and tolerant even before they knew what the sign meant.

    Why does America have to keep bringing in reduced wage labor and then wonder why there are people around who don’t like their lower position in society?

    Your claim that people were trying to get out a jury duty by claiming they were illegal aliens sounds ridiculous!

    Whatever sophistry you wish to use to explain why illegals come here, when you are broke Larry and want to migrate to another Country for a better life, you will be rather surprised at how you will be received. We are the most benevolent country for immigration in the world. It is easiest here. There is no excuse for breaking the laws.     As ridiculous as it sounds Larry, those are the facts, and the documentation to prove it has been presented to the election officials in the State of WA. It forced some resignations. In all the searches Eastern Washington has many illegal aliens that live in State,set up and even buy homes, and settle in, working illegally in farming. This is ending as tolerance has waned, actually due to the illegal alien protests themselves. It rather backfired with American citizens looking on and saying WTF.

    Sounds nuts that idiotic illegal aliens would get out jury duty by admitting that they were illegal, knowing full well that then federal law barred the State and local authorities from taking action. As non citizens they could not serve on juries, it was well known that this was the case to the illegal alien community. Upon being dismissed no further actions were taken. This is now changed.

    Those laws have all since been reformed, and the local and state police can arrest people for immigration violations and hold them until the feds pick them up. In the case of New Hampshire, the State charges the federal gov’t for the service of upholding its own laws, since they seemingly cannot, or will not.

    In the case of illegally entering the Country without the benefit of customs, it is a federal felony, and they can be arrested. In the case of overstaying their visa, it is a civil crime, and the penalties are fines, and being kicked out of the Country. These are the laws as they stand, and local and state law enforcement can implement them.

    I have experienced immigration laws in the progressive paradise of Canada, and I assure you, that you will be turned in by the locals there, and collected by the RCMP, if you are found out. You are immediately returned to your country of origin, and cannot be considered for re-entry into Canada for a period of no less that 10 years. Perspective Larry, the party is over.

    I was wondering what happened to you, I haven’t heard from you for a while.

    Lets get one thing straight. I am in favor of legal immigration. I am even in favor of a guest worker program to fill jobs that are needed in this country. I agree that Mexicans are good hard working people with great family values. I agree I would find it hard to live in a corrupt country that does not support its people. I tell you though if I had to live in another country I would certainly learn the language knowing that it would be the only way to get ahead. It is illegal immigration that are endangering our country because there is no way to regulate the numbers that come here, thus we are unable to provide for the new arrivals adequately so they can succeed. Instead, they are set up for failure and doomed to stay in the underclass cleaning our toilets and picking our food for life.

    I oppose this slave labor underclass that has developed because of illegal immigration. I oppose the fact that legal immigrants have a much more difficult time getting good paying jobs and experiencing the American dream because they have to compete with illegal immigrants for jobs and wages. I oppose seeing poor Latin Americans be exploited by unscrupulous thieving pieces of trash employers that pay them dimes under the table. They should be put in prison for a very long time and never be eligible for a business license anywhere in the United State ever again. I am opposed to Mexico exporting their poor instead of dealing with them there because of their massive corruption that they will not address. I am opposed to groups like MECHA and La Raza (The Race) that openly advocate creating an apartheid style Hispanic only nation of Aztlan in what is now the American South West (including Utah). I am opposed to Mexico wanting to take back what they say is theirs because they had it first when in fact they stole it from the Amerindians that had it before.

    I am opposed to multiculturalism because it is unity that made this country great, not diversity. It does not mean that I oppose diversity, however I know that diversity without unity is Balkanization which has been shown to cause conflicts and wars. Unity means that we are a diverse people working in freedom for a common goal of the pursuit of happiness and a better life for all. Not diverse people competing for their own cultural dominance (which is what multiculturalism has become).

    That is what I oppose, not good hardworking people that naturally yearn for what America has to offer.

    Head south on I-15 and exit #16 south of Cedar City. Head towards Hurricane, pass through, until you get to Virgin Utah. Take a left up the Kolob Canyon Rd.(signs for that entrance of the park) Drive 2.5 miles, on your right will be a clearing(fenced)surrounded by meadow, Cottonwoods will be visible, take the right in there…A fork of the Virgin River(Kolob Creek?) border the east side. Camp for free, it is a tiny piece of BLM, and as close to Zion as you can get for nothing.

    That part of the Park, is much less traveled.

    Last time I was there, not a soul bothered me, except for Cliff and 3 New Yorkers.

    rock star treatment. He should quit for the sake of the kids.

    Speaking of Obama, I came up with the perfect theme song for him. “Time to change” sung by the Brady Bunch kids. It’s all about change, but just like Obama it gives offers no ideas on what needs changing and what exactly to change. Obama speaks very articulately but his words are void of substance. You can see the Brady kids sing the song on my blog also.

    Since I am fair minded, I also make fun of Republicans too, I have a funny photoshopped version of “No Country For Old Men” with John McCain that I created myself. Let me know what you think of it.

    I agree that having two or more languages is harmful to a country. There’s nothing that makes me more uncomfortable then having to tell someone more then once that I can’t understand them or to be in the presence of other people talking in a language I don’t understand. I always wonder if they’re saying bad things about me. The only way I could stop that is to learn another language and that is something I definitely DON’T want to do because I don’t know if I’m smart enough. That being said, if I don’t want to learn another language, how can I expect someone else to try to learn mine if they’re old like I am or are working three jobs just to stay alive.

    Don’t we have hand held devices that could translate spoken Spanish into English and visa-versa. That would at least help.

    If Democrats are elected. I’ll bet they’ll offer free classes for people to learn English.

    Truth be told Mexico is not a poor country, it’s a corrupt country! There’s a difference. Mexicans do not live in horrible poverty. People in Nigeria, Bangladesh and Vietnam live in horrible poverty. If our goal were to offer an opportunity for a better life to people living in abject poverty, Mexico would not even be on the list of countries we would look at. IF after providing all available American workers with a job that pays a decent, living wage we still need workers for agriculture or such, why not bring in people from other countries who truly do need a helping hand?

    People who could not possibly pay a coyote thousands of dollars to smuggle them into the US? People who would appreciate an opportunity to work in the US on a temporary work visa and go home with a tidy nest egg? People from countries who have not fleeced the taxpayers of America. Countries whose leaders have not meddled in our immigration affairs with the intention of subverting our legal immigration system. Slam the door shut on Mexico and lock it. The world is awash in unskilled labor. We can get any workers we need from other countries. We don’t need the people from south of the border. Let’s lend a hand to people who will respect our laws and not burn our flag in the streets.

    There are plenty of jobs in Mexico. Unfortunately, we just happen to share a border with Mexico so Mexican leaders backed by their rich elitists ship their uneducated and poor to us to employ and take care of. Truth is, Mexicans realize that the jobs in Mexico pay significantly less with little benefits (thanks to their corrupt and oppressive government) than in the U.S. Why labor in Mexico at the wages being offered because they can make 10 times as much in this country. Why sweep a floor in Mexico for $7 dollars a day when you can come here illegally and make $7 an hour sweeping the same floor. Further, our generous social systems will actually pay you to have babies and give those babies citizenship, thereby providing an anchor to your presence. So on top of your $7 under the table wage, you can get an anchor baby, food stamps, housing subsidies, access to no cost medical care, education, and a bevy of activist support groups and immigration lawyers that will help you stay here.

    It’s as if they have hit the lottery and you can bet these people will never go back to Mexico so long as they have the economic incentive and a host of facilitators and advocates that abet their presence to remain here in this country.

However since he did smoke prior to running, it probably is genuine. I am glad to hear he stopped smoking. Since that is the case I will remove the photo. How is that for being fair minded huh?

    Also my view on immigration is not new. Everything I mentioned in that post I have written about before.
